1. Acceptance of Terms

1.1 By accessing and using Inside Pitch Club (the “Website”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to all of the provisions contained in these Terms, you may not use the Website.

2. Description of Service

2.1 Inside Pitch Club provides a platform where users can upload content, including but not limited to sound recordings, lyrics, song titles, and other related materials (“Content”), for professional review by experts in relevant fields and exploitation to other music and or television professionals for the purpose of securing opportunities for said materials.

2.2 The Website may also offer additional services and features related to content submission and review.

2.3 No guarantees are being made as to the placement of your music. Songs in the pitch catalog are not guaranteed to be recorded by a recording artist or placed in TV, Film, advertisements or any other form of commercial exploitation.

2.4 Inside Pitch Club is not obligated to accept your song into our pitch catalog or Bullpen program. Acceptance into either the Bullpen or the pitch catalog will be based solely on the opinions of the music professionals hired by Inside Pitch Club to evaluate your music. Being that music is a subjective art, it is entirely possible that a song that we pass on might go on to achieve commercial success through other avenues. You agree to hold us blameless for not including your song in our pitch catalog or Bullpen program.

3. User Obligations

3.1 By uploading Content to Inside Pitch Club, you represent and warrant that:

You have the right to submit the Content and grant the licenses set forth herein.
The Content does not violate any applicable laws, regulations, or third-party rights.
3.2 You agree not to upload any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.

3.3 You will not submitting any content that was written or co-written with the help of artificial intelligence. Inside Pitch Club will not pitch content that was composed partially or completely by AI.

4. License Grant

4.1 By uploading Content to Inside Pitch Club, you grant Inside Pitch Club a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to exploit any and all uploaded materials to song pluggers, publishers, record label executives, producers, artists, managers, editors, music supervisors or any other professional that may be connected to securing opportunities for uploaded materials. You also grant Inside Pitch Club the world wide right to use your name, likeness, biographical information, and uploaded materials for the purpose of promotion of this website.

5. Professional Review

5.1 Inside Pitch Club may engage professionals and experts (“Reviewers”) to review and provide feedback on the Content uploaded by users.

5.2 The reviews provided by Reviewers are for informational and educational purposes only and do not constitute professional advice or services.

6. User Content

6.1 Users retain ownership of their Content uploaded to Inside Pitch Club. However, by uploading Content, users grant Inside Pitch Club the rights specified in Section 4.

7. Limitation of Liability

7.1 Inside Pitch Club and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the Website.
Any conduct or Content of any third party on the Website.

7.2 Inside Pitch Club and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any copyright infringement or claims of infringement in connection with any uploaded materials or discussions of copyrightable material either by users of this website or third parties. Inside Pitch Club will not knowingly cause or allow any uploaded materials copyright to be infringed, however indirect infringement caused by a user of this website or a third party which Inside Pitch Club has exploited uploaded materials to will not be the liability of Inside Pitch Club and its affiliates, officers, directors, employees, agents, and licensors.

8. Modifications to Terms

8.1 Inside Pitch Club reserves the right to modify or replace these Terms at any time. The most current version of the Terms will be posted on the Website. Your continued use of the Website following any changes to the Terms constitutes acceptance of those changes.

9. Governing Law

9.1 These Terms shall be governed by and construed in accordance with the laws of The State of Tennessee, without regard to its conflict of law principles.

10. Refunds

10.1 No refunds will be given for unused services or membership. Pitches for members are limited to 10 per month and song reviews are limited to 1 per month. Unused song reviews and pitches do not rollover. Should you choose to cancel your membership, you can do so at anytime. You will be charged for the current month and will still have access to all of the membership services for the current month but your subscription will not renew and you will not be charged the following month and member services will be terminated.
